How Long Does the EB-5 Process Take?
One of the first questions any EB-5 visa applicant has is, “how long does the EB-5 process take?”
It’s a natural question and one that nearly every visa applicant wonders about in the early stages of filing for this investor visa. At the law offices of Ama-Mariya Hoffenden, we help applicants across Florida and beyond successfully apply for this immigrant investor visa, guiding you every step of the way and ensuring the paperwork is always filed properly.
There are six major steps to achieving your EB-5 visa and submitting a naturalization application for American citizenship, and we can help you with every step in this EB-5 timeline.
So, how long does an EB-5 take? The answer depends on whether you’re aiming to become a US citizen, or simply receive a conditional Green Card. Typically, applicants receive their conditional Green Card within three to six months. A permanent Green Card will be available two years after entering the United States, and naturalization can occur after five years of living in the United States.

Timeline of the EB-5 Visa Process
The EB-5 visa processing time is fairly short compared to some visas, but the whole process can take years.
Let’s take a look at the full process.
Initial Agreement Stage
The first step takes around a month, and this involves an investor agreeing with a new commercial operation in the United States. Money must be invested directly into the American business in a way that meets the requirements of the EB-5 visa.
This visa requires that money be “at risk,” meaning your presence in the United States is an important part of an investment you make in the overseas business.
Preparing Petition for Review
The second stage is where the law offices of Ama-Mariya Hoffenden come in handy. We will assist you, the investor, with all relevant investment documents and ensure your paperwork is in order and satisfies the requirements of the visa.
We’ll also help you with the preparation of the I-526 Immigrant Petition, which will ultimately be submitted to the USCIS for review.
This also takes place within the first month and can be done fairly quickly presuming all of your paperwork is in order.
Conditional Green Card
Sometime between three and six months after your application is successful, you’ll receive your conditional Green Card.
This is valid for two years and is conditional in that it will require you to maintain your investment in the American business after two years if you are to be eligible to remain in the United States any further.
Your conditional Green Card allows you to reside in the United States legally, on a full-time basis, for up to two years.
I-829 Petition
Two years after entering the United States, and assuming your investment in the American business continues, you will be eligible to submit an I-829 petition. This petition will remove your conditional resident status, granting you permission to permanently reside in the United States and continue your business operations.
Our law offices can once again help you with this application, ensuring all paperwork is properly filed and that your investment meets all required criteria to grant you the permanent Green Card.
Green Card
Once your paperwork is successfully handled and filed, you will receive a permanent Green Card. This Green Card will allow you to stay and work in the United States permanently, whether you continue your investment operations or not.
Your family will also be able to remain in the United States with you once the Green Card is granted.
Naturalization
After five years of being a permanent resident and investing in the United States, you (the investor) and your family will be able to submit an N-400 naturalization application. We’ll help you file the appropriate paperwork, ensuring the process is smooth and simple.
At the end of this process, you and your family will become legal US citizens, and be able to live and work in the United States for the rest of your life.
